Terms of Use

1. General provisions and definitions

In these Terms, the following terms have the meanings given below:

• “Company” / “we” / “us” — Outsi sp. z o.o., with its registered office at ul. Kartuska 2, 83-334 Miechucino, Poland, registered in the Polish National Court Register (KRS) under number 0000935494, NIP 5892069190, REGON 520550442, the operator of the Services.
• “You” / “Client” — the natural person who uses the Services, at least 16 years old (or the minimum age of digital consent in your country).
• “Services” — the Website, the App, the Survey, and all related features made available by the Company.
• “App” / “PWA” — the Pacti progressive web application available at app.pacti.ai, which you can use in your browser and add to your home screen.
• “Website” — the marketing website available at pacti.ai.
• “System” — the software, content, and infrastructure behind the Services.
• “Survey” — the on-site quiz used to tailor your first challenge and recommendations.
• “Agreement” — the agreement for the provision of the Services concluded between you and the Company on the basis of these Terms.

2. Creating an account

Some features require an account. You may create one using an email address or a supported sign-in method. You are responsible for keeping your credentials secure and for all activity under your account.

You agree to provide accurate information and to keep it up to date. You must not use another person’s account or share your account without our permission.

By creating an account you confirm that you are at least 16 years old (or the minimum age of digital consent in your country) and legally able to enter into this Agreement.

3. Suspension of Services and removing access to the account

We may suspend or limit your access to the Services, or remove your account, if you breach these Terms or our Acceptable Use Policy, if required by law, or to protect the Services and other users.

Where reasonable and lawful, we will let you know before we do so. You may close your account at any time from within the App or by contacting support@pacti.ai.

4. License to access and use the System

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial use.

All rights in the Services — including the software, design, trademarks, and content we provide — belong to the Company or its licensors. You keep all rights to the content you create (for example your journal entries and answers), and you grant us the limited rights needed to operate the Services for you, as described in the Privacy Policy.

If you believe content available through the Services infringes your copyright, send a notice to dmca@onsoul.ai identifying the work and the material concerned, and we will review it and act as required by law.

You must not:

• copy, resell, or commercially exploit the Services;
• reverse-engineer, scrape, or attempt to extract source code except where permitted by law;
• interfere with or disrupt the Services or their security;
• use the Services in any way that breaks the law or our Acceptable Use Policy.

5. Risks

The Services provide general information, prompts, and self-guided challenges. They do not provide medical, psychological, legal, or financial advice, and no doctor–patient or similar professional relationship is created by using them.

Personal growth and habit change depend on many factors. We do not promise any specific outcome or result. You use the Services at your own discretion and are responsible for your own decisions.

6. Payments and refunds

The core of Pacti is free to use. Optional Pacti Premium is a paid subscription. Prices, billing, the free trial, cancellation, and refunds are described in our Subscription & Refund Policy, which forms part of these Terms.

Payments are handled by our third-party payment provider. We do not store your full card details.

7. Third-party services and other disclaimers

The Services rely on third-party providers — including providers for payment processing, data and application hosting, and product analytics. Their services are governed by their own terms and privacy policies.

Some content and suggestions in the Services are generated using artificial intelligence and may be inaccurate, incomplete, or unsuitable for your situation. Always use your own judgment.

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

8. Indemnification

To the fullest extent permitted by law, the Company is not liable for indirect, incidental, or consequential damages arising from your use of the Services. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under applicable law.

You agree to indemnify the Company against claims arising from your unlawful use of the Services or your breach of these Terms or our Acceptable Use Policy, to the extent permitted by law.

9. Termination of the Agreement

You may terminate this Agreement at any time by closing your account and stopping use of the Services. We may terminate or suspend the Agreement as described in Section 3.

Provisions that by their nature should survive termination (for example intellectual property, disclaimers, and limitation of liability) will continue to apply.

10. Governing law and sanctions

These Terms are governed by the laws of Poland, without prejudice to any mandatory consumer-protection rules of the country where you live.

If you are a consumer in the EU, you may also use the European Commission’s Online Dispute Resolution platform. Any disputes will be resolved by the competent courts, subject to mandatory rules that may allow you to bring proceedings in your country of residence.

You confirm that you are not located in, and will not use the Services from, a country or territory subject to comprehensive trade sanctions, and that you are not listed on any applicable restricted-party or sanctions list.

11. Miscellaneous

We may update these Terms from time to time. If we make material changes, we will notify you by reasonable means (for example in the App or by email) before they take effect. Continued use after changes take effect means you accept the updated Terms.

If any provision is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, Acceptable Use Policy, Cookie Policy, and Subscription & Refund Policy, form the entire agreement between you and the Company.
